2. Purpose and scope of application

These General Terms and Conditions of Sale (GTC) apply to all services offered by Alice MD – Floral & Event Design, including the design, creation and installation of floral and scenographic decorations, and the rental of decorative equipment.

3. Orders and quotations

Orders are only considered final after the quotation and contract have been signed and a 20% deposit has been paid. Quotations are valid for 30 days from the date of issue. Any subsequent changes will be subject to a price adjustment and an amendment.

4. Payment terms

A 20% deposit is required upon signing the contract and quotation. The balance must be paid between 30 and 15 days before the date of the event. In the event of late payment, legal penalties will be applied, as well as a fixed compensation of €40 for recovery costs.

5. Right of withdrawal

In accordance with Article L221-28 of the Consumer Code, the right of withdrawal does not apply to personalised services or services provided according to the customer's specifications. 

6. Cancellation

Any cancellation by the customer must be notified in writing. The 20% deposit remains payable to Alice MD – Floral & Event Design. In the event of cancellation less than 60 days before the event, 50% of the total amount of the service will be due, and less than 30 days before, 100%.

7. Floral substitution

As plants are natural products subject to climatic and seasonal variations, Alice MD –

Floral & Event Design reserves the right to substitute certain varieties with equivalents

of similar quality and style.

8. Delivery, installation and dismantling

Any installation, handling or intervention not included in the initial quote and not agreed in advance, in particular the placement or movement of furniture, tables, ceremony chairs, or the installation of decorations provided by the bride and groom, their guests or other service providers, will be subject to additional billing.

Any request to modify, move or reposition an item that has already been installed (arch, furniture, signage, floral arrangements, etc.) at the request of the bride and groom, their guests or any other service provider will also be subject to additional charges.

These services will be charged at €80 per person from the Alice MD – Floral & Event Design team present on site, for a maximum of 30 minutes. Beyond this, the charge will be €60 per hour per person involved.

9. Additional services and change of location

Delivery and installation times are set in advance. Any installation or removal outside of the agreed times, particularly at night or on Sundays, will be subject to additional charges. Alice MD – Floral & Event Design cannot be held responsible for delays due to traffic, breakdowns, blocked access or third-party errors.

10. Storage and maintenance

Alice MD – Floral & Event Design's responsibility ends upon completion of installation. Floral arrangements are only guaranteed at the time of delivery and installation. Damage caused by heat, wind, handling by third parties or guests is not its responsibility.

11. Deposit and equipment

Rented or supplied equipment remains the property of Alice MD – Floral & Event Design. It must be returned in the same condition as when delivered. The amount of the deposit is determined according to the value of the rented or supplied equipment and specified on the corresponding quote. In the event of breakage, loss or theft, the customer will be liable for the value of the equipment.

12. Customer cooperation

The customer undertakes to facilitate access to the venue and to comply with the schedules and approvals necessary for the proper performance of the service. A lack of communication or approval within the deadlines may delay or modify the service without Alice MD – Floral & Event Design being held liable.

13. Subcontracting

Alice MD – Floral & Event Design reserves the right to entrust certain tasks to qualified partner service providers, under its direct supervision.

14. Obligation of means and force majeure

Alice MD – Floral & Event Design undertakes to use all necessary means to ensure the proper performance of the service. However, it cannot be held liable in the event of force majeure or unforeseeable external events (bad weather, illness, breakdown, etc.).

15. Post-approval changes

Any request for changes or additions after the quote has been signed will be subject to an additional quote and additional invoicing.

16. Intellectual property and communication

Unless otherwise stated in writing, the customer authorises Alice MD – Floral & Event Design to use photographs of the work in its communications (website, social media, portfolio, etc.).

17. Protection of personal data

The data collected is used exclusively for the management of services and is neither transferred nor resold. The customer may exercise their right of access and rectification at any time by contacting Alice MD – Floral & Event Design.

18. Consumer mediation

In accordance with Article L.612-1 of the French Consumer Code, all private customers have the right to seek the assistance of a consumer mediator free of charge. The competent mediator is: Médiation de la consommation AME 11 place Dauphine, 75001 Paris – www.mediationconso-ame.com.

19. Applicable law and competent court

These terms and conditions are governed by French law.

In the event of a dispute, the courts of Draguignan (Var) shall have sole jurisdiction.
